Our HOA is considering a liability insurance requirement for all resident golf carts that are used/travel on HOA roadways.
Our Golf Course (owned by an outside entity) has this requirement for those who use their personal Golf carts on the trails.
Does anyone have this reqirement in their community?
Is it legal and enforceable?
Is it a good idea based upon your experience?

Your HOA should have general liablity insurance anyway. I'm not sure how that would differ just because someone is on a golf cart IF IT IS WITHIN THE LAW. In our municipality, it is against the law, but we have about 4 of them in our sub, and they are on our roads all the time.

It is against Florida Law to operate golf carts on any city, county or State street or roadway.

The association should not carry additional insurance covering these carts. That would fall under your general liability policy. Driving a cart within the community is owner responsibility and is usually covered within the owners individual liability policy. The golf course also has liability insurance for their property. We had the Sheriff of our counnty send out notices to the few who continually drive the cart within the community ,to no avail. A real problem is that they let their young kids (10 and 12 year olds) drive them with 4 extra passengers hanging on for dear life. We the residents are just taking charge of this and stopping them in the streets and calling the parents. They usually say that it soesn't bother them that their kids are driving fast and being reckless.

I guess I didn't explain it very well.
Our HOA is considering a policy that would require all residents who drive a golf cart on HOA owned (private streets within our gated community) streets to carry liability insurance on their individual golf carts and provide such proof of insurance to the HOA.
Do any of you have this policy within your own community and how enforcable is it?

That is a little clearer. You said that your "HOA is considering a policy" and you mean to adopt a policy, correct?

Now, IF the Board decides that they want to add this to your Rules and Regs, they absolutely must write the rule , send it out to every owner, call a membership meeting AND State Statutes require that the meeting is to have a 14 day notification to the membership of the purpose of the meeting.. The Board is the only vote required but notification is required and then each owner is to get copy of it.

As I said before, I believe that self owner golf carts come under a Homeowners Policy coverage. A seperate policy can be written but your enforcement will be very difficult to monitor. If and when golf cart owners do obtain a seperate policy, then getting them to show proof to the association will be a snap but to force them to get it will be tough. Is it an illegal rule? I don't believe it is as long as your roads are private and it is a written and passed rule.

How would you get insurance on a vehicle that you plan to drive illegally? Why is your HOA allowing these to be driven around like a car on your roads?

On our Island, our roads are private. We can receive police support from the county, we have our own POA that setys rules. Gold carts are a way of life and we now have a $200 fine for uneraged drivers. Drivers must have a license and cart is registered with our security and has insurance.

One problem, people will trailor in golf carts for short term rentals.
Also, you can rent golf carts from developer (insured), anf rom private firm locally, all carry insurance or supposed to. I would not want to be the owner of a non insured golf cart involed in an accident with injuries.

PaulF: No one has asked are your community roads public (county owned) or private? If private, check with your own insurance agent to learn what insurance, if any, is available for golf carts on private roads, and can a 'rider' be purchased?

Don't see how the Board can pass a rule that would force residents to have insurance on their golf carts. It is strongly suggested also that each unit owner have personal homeowner insurance on their unit, but it cannot be forced.
