Our HOA in NC withdrew a sum of money to purchase new plants for the front of the neighborhood- not all the money was spent, and should have been returned to the HOA account.

Now, the President that took the money says she has no record of returning and the Managemnt Co. has no record of receiving.

The Board voted to "write it off" and not have the President pay any back.

This is not the only example, but wondering if anyone knows how to fight theft on a board. Short of myself as a homeowner going door-to-door to see if I could get 51% to go to a special meeting. Last annual meeting for our neighborhood only brought in approx 15 people out of 160+ homes.

If board can write off whatever, what would prevent them from withdrawing funds and doing this over and over- oops! no records! we need to write it off!

What does she mean that she cannot remember if she returned the unused money. Isn't there a receipt? Every dime spent by anyone in doing a service to the community has to have receipts and invoices. It cannot be that much that she wants to make a killing from unused association funds. I would hope that the Treasurer can solve this problem otherwise Madamn President doesn't get another dime for anything, comunity project or not. Have the other Board members ask her in a group setting. That might shake her memory.

Who gave this President money? I take it they gave her cash. Now that is not the smartest thing you can do. Why in the world would the Treasuer ar any management company have need to give an owner any money for anything. It could be sloppy business but what ever it is, it should not continue.
So first thing to accomplish is to stop the practice. You will not be able to do this own your own. If you can not generate any interest in your community, just the fact you have this kind of issue should be enough to stop the practice.

However it turns out in regards to the specific issue, your problems are not solved. Some of the owners have to be convinced they need to take a hand. You start off and get one supporter, have that supporter get anothe supporter. It can be done and it must be done. Start or have a town meeting, bring up the issues. But first send the board a certified letter, receipt requested and ask to review the daily financial records for the time you are concerned about, write all this stuff down or better copy it. Find the holes that allows for this kind of sloppy bookkeeping. Get back copies of financial records, get copies of Board Meetings and annual meetings, get treasurer reports, any audits or lack of, any kind of information that settle money accounts and how paid.

If they don't respond bring the issue before your town meeting. It will be tough on you but with a couple of supporters you will get their attention. Go to legal aid society and see if they can help, go to BBB, speak to your councilman. Get some attention, get the light over the associations head. I am absolutely positive you will find some kindred souls in your association. Talk to you local political representative, get him to writew them a letter. This is not new and it is never easy, but it can be done.
