I am a new developer, who has developed an equestrian subdivision. The charter and covenants were all set up with our attorney. Sixteen of the 24 lots have been sold and we need to set up the association, set the dues and start collecting as we have mowing and maintenance cost that need to be paid by the association now. Does anyone have any suggestions on how we begin? I have asked our attorney for help with this, but as usual, am not getting any response.

SharonA1: If you are not getting any response, as usual (!!!), then its time to find another attorney. This requires legal counsel and legal filing, as you must be aware.

I worked for a developer who did the due diligence on such a development. I would suggest you talk with a management company who has managed such a community in your state, who would be aware of the applicable laws and have them review the work of the attorney from the viewpoint of what is going to happen when people and horses move in.

Good luck, I loved creating unique communities!
