I recently noticed the sheet rock on my ceiling was bowing, and wet. I live on the top floor, and the property management company sent out someone to look at the roof, and they noticed a leak in it. I would like to know if I am responsible to fix it or if the property management company is. Also should I worry about mold. They also told me they had this problem 2 years ago but thought they fixed it

DavidA4: The only way the ASSN. (not the Mgmt. Co.) may be responsible for repair of the roof is IF the roofs are listed in the Declaration as common area expense. Review your docs.

I agree that your documents will tell you who is responsible for the damage but since you say you live on the top floor I assume you live in a multilevel condo and in that case the condominium association would be responsible for a damaged roof and ceiling. Your personal condominium insurance would cover any damage to your furnishings from any dripping water.

In the condo that I own, the association is responsible for all common elements, which includes the roofing and all sub structures supporting the roofs. The drywall is always the owners responsibility.

Now, the drywall is ruined and needs replacement because of a failure in the outer/common area (the roof) and nothing to do with failure on your part. This is where you are at the mercy of your documents on common elements. They may be held responsible because of their failure to repair and maintain said roof. Read your documents and the coverage responsibility should be stated in there. If not, then you will have to fix the interior and appeal to the Board for reimbursement.
