1. Can a Homeowner video tape a monthly Homeowners meeting ? 2. Can the Board vote NOT to let you video tape a meeting ? 3. same as above except audio tape a meeting ? 4. Are there any laws that cover the above ? 5. The Board voted NOT to let me video tape or audio tape the meeting and threatened to call the police to have me removed if i insisted on taping. I told them to call the police and they decided to adjourn our HOA monthly meeting. 6. Please help me with any comments. Thanks Fred The Board taped the Jan. o6 and Feb. 06 HOA meeting. |

i am not a lawyer, but i don't think it's illegal. If the meeting is held in a private residence, they may have some leg to stand on. If they have videotaped previous meetings, they lose a lot of legal leg to ban future recordings. One nice thing to remember: Federal Wiretap laws say one party to a meeting must be aware of the recording, not both, to be legal. California differs slightly, i believe. |

Remember, you are a member of the association. The board meeting is of your membership; if you have a right to be in the meeting, you have a right to Minutes (which if yours is like mine, you'll never get them) and to taking notes; if you choose to take notes with a videotap, I can't see that they can stop you. You have more rights to a meeting than someone from the press because you are a member. It sounds like this was making them nervous--why might that be?--that they didn't plan on recording something accurately in the Minutes? It happens! EdR |

Not necessarily. 2. Probably 3. same as above 4. That would vary from state to state. In Colorado, according to the advice of an attorney, a board can adopt rules prohibiting any member use of recording devices. Of course, the board can tape. 5. Not surprising 6.
