WE are having a problem with a few homes not paying the dues owed to HOA. One home is in forclourse, the other two are here but say they are not the owners. We really have a problem firist time in 28 years from what i hear I thought maybe someone else is having problems or can guide me as to what to do?I am in a age restricted 55+ and it is getting worse. Also anyone hear of the rules made being a Gentlemans Agreement? As to they really do not stand up leagaly? Thanks a bunch. Happy New Year to all. [email protected]

It is sad to hear about delinquent owners and dues not being paid. I think that we all have had to deal with this issue. These are the times for them.

Anyhow,we send out a letter and ask for a response. We send out the 2nd letter by certified, return signature mail, asking for a response. Usually by then we hear from the owner. We have even set up easy patment schedules for some who deserve a helping hand but others are just palin slackers.

If we don't hear back, then they get a formal letter from the association attorney, demanding payment or communication. State Statutes require 45 days after the registered letter is signed for before a lein can start to be processed.

Don't believe this Gentlemen's agreement stuff. Your owners are responsibile for paying their assessments. Look them up at the court house, send them a registered letter with a time limit to comply. If they don't inform them their bill will be turned over to a collection agency and their credit rating will likely be effected. Also, the property in foreclosure should have an official lein on them filed with foreclosure papers. You may get something if there is any cash from sale of property, get in line. You can use this information that Donna refers to as guidelines on the process.
