Can I "sue" my homeowners association for specific performance? I live in South Florida and its my understanding that my HOA is contractually obligated to maintain the common areas, however, a specific area is not being maintained and I have complained about it and so have other homeowners. The management says they are working on it - but other areas in this community which suffered the same, have been improved.

Kimberly, the answer is yes. Anyone can sue for any reason but doesn't mean you should. You probably have many other means which can be more effective. Perhaps a letter from an attorney would be more appropriate if the Board just ignores a "reasonable request" for which they have adequate resources.

Don't let your upset and ego cost you a lot of time and money by jumping into a legal battle which you may well lose.
