We have a problem with the developer who is chairman of the hoa and wants to turnover the hoa to lot owners. He has violated his fiduciary responsibilities in managing the hoa...never got insurance and never opened up accounts (checking and savings)
and is making us pay maintenance for ponds that were never subdivided as common ground.

You don't mention what state you are in, but I would be looking for an accounting of all the funds paid in. In most states, this is a bare minimum requirement. Send something in writing requesting it.

Also, visit your state web iste and find out what your rights are and the applicable laws. Knowledge is power.
