I live in California, and I have two hoa's due. One for the master community (which includes hundreds of houses and condos); And, one for our sub-association.

The kicker is the builder built four different styles of condos within the sub-community (by the way, it's very small--only three streets), all of whom share the same sub-assocation space; However, only my style condo is obligated to pay the second sub-association fee.

Ironically, the master and sub-association is managed by the same company. Is it possible to eliminate the sub-association fee?

What you have to do is combine all the condos into one. Then apportion the dues structure. And I would request the developer pay for this, and if he don't and what you are saying is fact, then take him to court. How in the world was he ever allowed to turn the property over with this kind of structure. You all need to get your thinking caps on and do this right.
I think you got a mess.

A short version of how an apportionment is done:

All this sub association should total 100%. Take the price that the units sold new, add all the prices of all the units and this number you devide into each unit price as sold. This will give you a portion for each house, not all will be the same but they will all add up to 100%. Whatever your budget is, each unit will pay their apportionment.

A couple of questions:

Does your sub-association have it own Board of Directors?
Does it have it's own budget?
Do you know what expenses your sub association dues pay for?

It sounds strange that only style of condos would pay this fee and the others wouldn't unless there is some special common expense, such as insurance or utilites or trash pick up, that are charged to your style condo as dues and that the other style condo owners pay themselves.

Any more details would be helpful.

There must be some physical reason why you are being required to pay this 2nd sub a ssociation fee. You are obviously sharing some common interest. It should be spelled out in your documents.
To eliminate the sub association fee would have to be done thru an amendment for the entire developement who probably would be assuming some of your sub's dues. I'll bet you alot of money that they would never allow that to pass. Give us some more details as to what you pay and they don't.

Are you stating that all owners who have bought the same style unit as yours are required to pay the second sub-association fee? If so, is it stated in the official documents? and for what reason?

Have you asked the management company for proof of why your 'style' unit must pay a second fee?
