Hi Everyone:

Can someone educate me on the difference between a POA vs an HOA. Our community in Atlanta is talking about the idea to move to a POA. It is a controversial topic and I can't seem to get a handle on the benfits of the POA or the difference between the two.

Some people seem to be against it, but their reasons does not seem irrelevant to what the board is trying to do.

There have been many previously written posts exclusively discussing the BENEFITS to an association to OPT from an HOA to a POA.

Use the search box in the upper right hand corner of this page by typing in POA (property owners association)

Many of the “standard” covenants of a POA are of those many BODs have contemplated amending or have amended in the past. For instance: Limiting rental properties, lowering quorum count, contribution fund (when transfer of ownership of a home, within the community is one year’s assessments), and many many more that may or may not be beneficial to your community.

I would review the purposed POA prior to “opt-in” as too see “IF” it would be benefit or be any more cost effective to your community, oppose to amending the covenants individually. Both of which will require a POA/HOA attorney to rewrite the covenants and a lot of time!

I will continue to look for information within my favorites and post any information that will help you to differentiate between the two.

As you may or may not be aware the majority of governing documents will expire in 25 years, unless otherwise renewed,updated or ammended. Were in a POA the covenants NEVER expire, they are deeded to the land.
