Hi I just moved back to the neighborhood I grew up in and love it. There is a hoa and the current President does nothing. We have had some minor issues that he will not even address, example renters dogs loose and smashing my garden, a bear loose in the neighboorhood, and there is now talk of a state prison going in approx a mile from our neighborhood. Half of the board is on the verge of quitting or have already done so. After talking to a board member I have tossed my hat into the ringh for the next election. I want to get our neighborhood back to the way it was when I was a kid. I know it will be rouhgh at first but I am looking for suggestions that will help us to succeed. Anythinhg would be great.

Of the three things you mentioned only the loose dogs is an HOA issue, and that is only if it is in your covenants. For example in our neighborhood we can't do anything about dogs, that is a city issue. My suggestion to you is if a dog is loose, photo it, send to your local police department and ask them to address it. More than likely there is a local ordiance against it.

As for the bear, again that is an issue with the local game warden or animal control, the hoa shouldn't be thrust into it. If you see it, contact local authorities, that should go for all your neighbors.

As for the prison, I can see where this can be construed as an hoa issue, but really it is a neighborhood issue. Your whole community and surrounding communities should band together and fight this if you don't want it. Perhaps your president should lead these efforts, but they don't have to.

I applaud you on getting involved though, communication is key!

ScottH5: Since you have not really explained what 'things' the President has not done, it is difficult to post to you. As far as the bear being loose, you can obviously report it to your local authorities. As far as the prison 'going in', don't know how you could stop that....

It is in your greatest interest to read, read and re-read your official documents, CC&Rs, which detail the governing and election process for your association, and also the restrictions as explained in the docs and in any Rules and Regulations which have been created by the Board. You can best serve the residents if you know and understand what the CC&Rs expressly allow and do not allow to aid the Board in governing for the common good of all residents in the community.

Read your documents! That's always first. If your board is ready to resign over the president, they have the world turned upside down. They simply vote him out. Any officer can be removed by a simple vote of the board - in most cases. What do your documents say? They may not be able to take him off the board, but surely they can remove him as president.

Of course, then one of them will have to step up and get voted president, won't they. It's not as easy to do these jobs as folks on the sidelines want to believe.

Thanks for all the info, I do realize that some issues I mentioned are not really an hoa issue. I as may people beleive there is just no communication from the pres. He will not communicate with anyone who trys to find out any info about were our funds go from why he destroys our equestrian trails. I do realize that it is probablly not as easy as it looks from the outside but no one can get anywere with this guy. I will take all the advice given thanks.

Why do you think it is ONE person who controls your organization? There is an entire BOARD, plus the general membership.

If things are so intolerable, call a Special Meeting of the Members to discuss your concerns.

See your bylaws and/or convenants or State nonprofit laws for how to do that.

ScottH5 - Now you are talking about some issues under HOA BOD control. Communication is key, so offer to work with the BOD to write an association newsletter.
