Obviously, your Board and Attorney either have not reviewed your own official document which clearly defines the process to amend; or they don't want to follow the legal path/

If it's the latter, IMO, it would be wise to go on record as a Board member, (whether you make a statement at the Board meeting, or write a letter to be included with the minutes) to emphatically state that you are not in agreement with the voting process to amend since it goes against the Declaration itself.

That is a great idea. I’ll begin writing it today and go on record saying just that.

I’m thinking the attorney and the PM have also read it and figure the other HOs won’t contest it enough to were the purposed amendments won’t pass.

I too have read our covenant and it specifically states how to amend the covenants. I don’t see what “they’re” second guessing it!
