Our HOA in Virginia has a rule stating that our private street (called Colonial Court) is a public right of way which is privately owned and maintained by the association for motor vehicle traffic only.
Although there is a trafic sign on both end of the street "Slow children at play" all walking is restricted to the only one sidewalk provided to transit the area.
The tot lot has been already converted in a bush landscaped area to avoid maintaining the grass damaged by dog walkers.
Can I go again this statement, the children could use the court privately owned by the association as a play area?

If the Association has a rule prohibiting play in this area then IMO - No the kids can't play there.

BernardH: I would again check with your official documents to learn if it states that the street which is maintained by the association, is also a public right of way. If you cannot find it in the docs, check it out with your local municipal office. They can advise you.

If the street is also for public use according to the local officials and your documents, then it would not be wise or safe for children to use it as a play area.
