One of our owners died and left no will. His estate is in probate and the Public Administrator has sealed his door. The HOA has two concerns. One: how can we get paid for the monthly dues? Two: shortly before his death, the owner had a plumbing accident and we are concerned about mold-how can we gain access to his property to take care of the problem?

The body's not cold yet and you're worried about your monthly assessment payment? Have you ever heard of probate? Legitimate bills have to be paid before an estate can be settled. But do be sure to tack your late fees and charges on. Jesus. Harold

Hi Harold, I know it sounds cruel but the death was in December and we have not heard from the probate attorneys nor the city/county. As a five-unit complex, we are in trouble if for months we do not get 20% of our "income" each month. In addition, this unit owes additional monies to the HOA for a special assessment done last fall. Lastly, we have very little contact information for the person that passed, he was a very insulated individual and it does not appear that there is any local family. Should we be filing paperwork or contacting someone?

yes, you should seek out the probate court and get your concerns in front of the lawyers. If you sit meekly and await "justice" from the courts, you will never get anything.
