My association dues were due 11/28. They were postmarked 11/27. They will not disclose the actual receipt date and are charging me a late fee. Is this appropriate?

What do your association documents say on this matter? Our dues are due on the first of the month and if not received by the 16th (15 day grace period) late fees are added.

Are you habitually late? There has to be at least a 5 day grace period. Where are they sent? To a bank or management company?

Was that the INVOICE to you? Or your payment to them?

Late is late. Check the rules to see if it says "must be received by . . ."

I doubt if your payment got THERE by the 28. My township water bill payment and my credit card payment are real adament about "received by" - looks like your association is too . . .

I can’t agree nor disagree with its appropriateness. However, as previously posted I do feel that your BOD are not being sympathetic or gracious, by any means!

Read your governing documents for when payment is due and when it is considered late.

Mine reads assessments are due on or before January 1st and considered late if received after the 10th. One must keep in mind, that there isn’t any mail on Sundays and the USPS is truly very hectic for the holiday season. Which means it’s YOUR responsibility to make certain that payment is received on time.

I would suggest discussing this in great detail with your BOD. “They” should waive any late fees, “IF” they aren’t MONEY HUNGRY, IMHO!

Michael, most association's have a due date and allow a grace period of 10 to 15 days for receipt. If you are being charged a late fee your payment obviously did not arrive by the deadline defined by your HOA.

If you haven't been late before then I think it is absurd. Appeal to the board, perhaps it was charged by someone without knowledge of the postmark.

Confirm the due date and grace period here. Not clear... but also check to see if they are using a banking lockbox. Sometimes your check is going almost all the way cross country, so it might be taking 3 days for the check to post.

Whats the point in having due dates if they are not enforced. Of course he should be charged a late fee. I bet you will not be late again, which is really the point.

I am also glad you don't run my HOA. I agree, if they are a couple weeks late and have no reason absolutely a late fee. But if they mailed it and was postmarked before the due date then the board should have some flexibility. Remember you have to live with these people, why make life harder unless there is good reason to.

My dues are due Jan 1 must be received before Jan 30 to avoid late fee. Is it possible there's some confusion here between due date and end of grace period? Anyone besides me find a due date on the 27th of the month a bit odd?
