Hello Everyone,

I have written to you on several occasions about my volunteered BOD's in Florida, amending our Articles of Incorportation to compensate themselves. Our statutes say in short, compensation with our dues is prohibited. Our dues were also increased to cover their salary to themselves.

First, their amendment has been recinded.

Second, it is still in discussion mode to have everyone who received a check at our last Annual Meeting, to return the amount of the check they received (not everyone got the same amount) back to our Association.

Believe this! Those who received their illegal check is refusing to return the money they received. They feel they shouldn't have to. Since I have been on the BOD's from another Association in Florida, I already knew the $100 check I received as a committee member was illegal, and I did not cash the check, but instead, wrote "VOID" on the check and kept it for evidence.

Third, we aren't there yet, but should be. That is, for the BOD's to decrease our yearly dues back to where they were in 2003. For our dues were illegally raised to cover the BOD's compensation.

Recently, this same President who encouraged the BOD's of 2003-2004 to amend our legal document has quit as our President. Leaving this HUGE mess!

The President says her reason for leaving is she now has two different kinds of migrain headaches.

What would you say or do about the President quitting?

Audrey: You surely have a Board of Directors that do not like to abide by the laws. The Florida Statutes state that Board members may not be compensated just for sitting on the Board.Because the President quit doesn't exonerate her from any wrongdoing because she was President at the time and had an active role. I would contact an attorney for legal advice on how to handle this situation. I am the President of an HOA in Florida and can't imagine that any homeowner would go along with this... I hope you solve this problem.

I would say that your president downright quit because she simply can't take it anymore. That life is not worth all those people who are never happy, no matter what. I think she quit because she does not have complete control over what board members say and do, and yet is constantly blamed for everyone else's behavior. I think she quit because she is tired of non-stop cranky letters and e-mails that take up her time and for some reason, never accomplish anything. I think she is quitting because she truly wanted to accomplish something and being president has been more of a nightmare than anything else. I think she is quitting because homeowner's love to go behind her back and complain and nit-pick to anyone who will listen and then they show up at meetings and NEVER say one word in disagreement, causing her to never know what homeowner's are really thinking. I bet people lied to her and I think she is very disappointed.

I also think that if you want to see real change in your board, realize that this is the time for change and everyone needs to be positive. In time you will see that all of the funds will be paid back. I don't see where she is leaving a huge mess. By the way, what were your dues and what amount were they raised? What amount do you expect them to decrease to?
