Everyone,
This thread has wandered from subject to subject but mostly the posters are more toward the positive for having H.O.A.s The bad news is that so many states have such lax enforcement of the few laws that they have concerning HOAs.
Florida,? Well we have 40 some pages of statutes. Tennessee? They have none at all and so down the line are the abilities of states to have some form of uniform laws and statutes. The great news is that the Federal government has not gotten it's nose involved. Can you imagine what that would be like?
HOAs are as good as the residents allow them to be. Hate your CC&R's? Change them! Got a wacky president or disfunctional board? Recall them! If you can't follow the rules? Move! I am a huge disliker of resident appathy towards their association and it's functions. When I read some of these posts, it is clear to me that many association members just plain don't care as long as it is not bothering them personally. This is the lifestyle that you sign up to live when within a deed restricted community. My community? well it took us 5 years to whip it into shape--by amendments, ccr rewrites and several board changes but it hums like a well oiled machine now. Was it work? You betcha! Are the residents pleased with the way it is working now. More than likely because the number of homes for sale is less than 1 %.

Well as President of our Board I make it a point that I listen to the members and try to be fair to everyone. The only people that we have problems with are the ones that don't want to abide the Covenants, which they signed and agreed to. We contact them several times and try to resolve the violation but they ignore us until we finally have to fine them or file a lien. The next think you know, they are screaming about how aweful having a HOA is.
