Hi,

I live in a small community of 50 homes in the state of DE. Our restrictions clearly state the following:

Section 1. Private Residences. Each lot in the subdivision shall be used for private residential purposes only and no buildings of any kind, except private dwelling units shall be erected or maintained on any lot.

My question is, can someone run a company with employees coming to work in one of these 50 homes?

You doc's answered your question, private residental purpose. Check further in your doc's they may refer to businesses being conducted by homeowners.

Hi,

I checked and we have nothing in our documents about running a company. This is a HUD qualified age restricted community but we do have this situation today.

Drew, based on what you have posted I would say if the business is a disruption to the community I would look to see if your CC&Rs has a nuisance clause. This would apply when combined with "shall be used for private residential purposes only".
