How can a Hoa find the mortgage co of delinq. Ho dues, so we can file leins. Why do we have to give the mortgage Co. 60 day notices. I'am a board member of a Hoa with 275 homes. and we had attorney send demand letters of the 22 we sent 2 paid in full 2 sent partial pmt. 2 signed promossory notes. only 1 has made a pmt.

Hi BF: Does your association have a Mgmt Co.? I am on the Board of Directors for our 307 member association. We have a Mgmt Co., who maintains all information re: Mortgages, etc. They also prepare Liens notices that are sent out after a vote of the Board. If you do not have a Mgmt Co., perhaps you could search your County's Property Records to obtain the information you need.

The info is a available in the County records for that property.

May I ask if your trying to lien the mortgage company or the homeowner? If the mortgage company has the home, it's most likely been foreclosed on by them. Once they sell the property, they may pay up like everyone else. Banks/mortgage companies aren't the fastest to pay up on HOA dues when they get the property. They don't tend to react to liens until the last moment if at all.

If your really needing to lien the owner, you can find that information from the Tax assessor's office. If you know the lot number of the home, they should be able to give you the owner's name. The address should be the address of the property in the HOA though. So you may have to do some more "digging" to find the real owner's address.

With regard to the original post, I have a question. Our Condos required each member to have a single file in our office. All correspodence related to that unit is on file there. We also require a current address.
If a bank takes back the mortgage, or some other kind of lender, is the procedure different for different type mortgagors. Can the association treat these lenders the same in their efforts to collect current outstanding bills of the owner, and if foreclosed are actions the same by the associations?
