Senate Bill 100 requires an association to adopt 7 Policies and Procedures which are specified. It suggests but does not require others be adopted.
Further it requires all rules, policies, procedures and other governing documents be published and be provided to all members. It leaves to the board the method of "providing/making available". Board does plan to publish and mail them to members and put them on our web site.
Our board recently adopted the "7" required and about ready to make provided to members. Our governing documents like declaration, articles of incorporation, bylaws and covenants have been made available.
Section 38-33.3-209.(2)(g) Public disclosure required, says, "All the associations bylaws, articles, and rules and regulation." will be provided to members.
However the board does not believes SB100 requires any of our existing ones, written/some not, have to be in writing and available.
Some examples, Architectual Committee Policy, Covenant Variance Policy and Procedures, and Road Damage Deposit (during home construction).
Some unwritten, distribution of excess proxy votes (bylaws alloow one member to have 20% of total), real estate sign limit policy,and
snow removal policy (will plow after 6 inch snowfall)
