I’m curious what rights a president has. First . She appointed herself with no votes taken, family members. She says it’s illegal to take minutes of meetings. She says she has the right to do what she pleases and there is no need for voting.she has also changed bylaws that were previously voted on because she said the vote wasn’t legal. She is sending legal letters for evictions for a multitude of reasons with no previous communication. Then she sends you a bill for the legal letters. I am so disturbed by this. any ideas on how we can get out of a situation where we live under a dictatorship?? Any help would be appreciated.

I was going to go with funny to start but I resisted. Can you tell us a little about your HOA?

How large is your HOA? Condo's or Single Family dwellings? Do you have a PM or are your self managed by your Dictator?

First, is there a functioning board of directors? Second, obtain a copy of your HOA's Declaration and its Bylaws and study them. When is the next election? Is this person even running elections?

Are you on the Board, Rosemary? How many directors should there be according to your documents, probably your bylaws??

Read your bylaws to answer your other questions.

In a nutshell, though, boards govern HOAs, not any individual including the president. Boards vote at open meetings in Fl (except on rare matters that must be in closed or executive session)

Like CA, I'm sure meeting minutes are required by your bylaws and certainly FL law.

If other directors are ignoring her behaviors, they may find themselves in legal hot water for permitting her to engage in illegal actions. Ideally, the other diretos would simply b vote her our of the office of prez.

Got a feeling this isn't even an HOA, but rather a volunteer group or management person hired.

Just a hunch.

Hi RosemaryS1, a Florida HOA is required to have at least 3 directors. Assuming the president is also a director (a/k/a board member) where are the other directors on this? Something doesn't add up.
