Our property manager does not send an approved (or any) budget to the unit owners when announcing the annual meeting, nor does he send anything to unit owners after the meeting (which is sparsely attended). There are many other problems - revealed budget does not balance, proxies not counted, no agenda, no prior year minutes, Robert's Rules not followed etc etc.

NC statute requires the approved budget be sent to unit owners when setting a date for ratification. He meets any challenge or question with derision or condescension. He will ignore any letters sent to him by homeowners; the board is completely ineffective. What can we do to make him embrace at least this responsibility? This is a townhouse community of over 120 units, over 50% of them owned by investors, i.e. rented out.

You must band with other Owners who share your opinion of the PM. But y'all need to pressure the Board to direct him to abide by his contract with your HOA.

What does the contract say he must do, Rose? Most states permit owners to review executed contract so find out if NC does, get a copy, and WITH others start nagging the board to do THEIR job, which in part, is to direct him to do HIS job per the contract, which I hope include some phrasing that the Mgmt. Co. must comply with NC state law and your governing documents.

If the Board refuses to instruct & direct your PM, vote them out at the next election.

I am curious. In your association, who actually approves the budget. I have never heard that the PM actually approves the budget. The problem is two-fold, as you stated, an ineffective Board and over 50% rentals.

That's the correct answer. If over 50% of the homes are investor-owned, however, that could be a tall order.

What is the PM contract say their involvement is? The board typically is responsible for making the budget. So not sure why the PM would be doing this. They are a PAID contractor to the HOA. They aren't HOA members. So they aren't under HOA rule but contract.
