We would Like to start up a new HOA...The Developer is ready to hand over the common property and relinguish his majority votes...there are 14 hosues in the community and 15 other property owners that own lots in the sub division.
1. What is needed from the developer?
2. Does the HOA need a lawyer?
3. What other advice do we need tp know?

Not familiar with Tennessee law, but I would start with your State's website. Most have applicable laws available online. If they do not for some reason, then they would likely be able to point you in the correct direction.

Gather all of the Tennessee laws and that pertain to HOA's. Visit other HOA's and review there governing documents and tips. Be very careful with the transfer of the money that the developer says you have. Review the governing documents, the Rules and Regulations and every other document that you receive, to determine if they are practical for your needs.
