Hi all,
So here is our problem......
We are a single family 980 sqft units 22 in all. Each unit gets 3 spots garage,driveway & infront of unit.
Guest parking is 11 spaces total.

We have one unit that has 3 cars but doesnt use their garage and we fine them and fine them ....they just pay it.
but now the problem is arising that they weekly are filling the guest parking 7 to 11 cars on the weekends. Stating it family gathering and dinners.
Guest parking has been first come first serve with no resident or guest parking over 48 hours.
this is causing huge problems with the other resident since there is no parking for their guests.
How do we enforce or change our bylaws to fix this problem. They even joke about having a parking ticket jar when they have texas holdem parties.

Regarding not using the garage for parking: Change the fine schedule so that repeat violations within say two months cost increasingly more in fines. E.g. first violation = $25; second repeat violation within one month = $75; third repeat violation within one month of second = $250.

Regarding using all or nearly all the guest spaces on weekends: Can you quote exactly what your HOA's Declaration says about parking? If, say, the covenants are vague and say the HOA may regulate guest parking, then implement a rule that no more than three guest parking spaces may be used at any time except by written permission of the board.

Before fining for amount of cars, your docs should be explicit in how each car should be parked prior to using outside parking, re: 2 in garage, before three space is used. In regards to guest parking, each unit is assigned one guest pass. No more than one can be used at any given time, more than they will be fined and possibly towed.

Do you have any language in your covenants that says no one owner or resident can monopolize the amenities?

I'm with AugustinD. Increase the amount of the fines. The purpose of a fine is to gain compliance, not to punish. There's ample evidence for you to determine that the current amounts aren't enough to gain compliance.
