Does any one know if it is Texas law to carry some sort of liablity insurance? We just started our HOA and currently we do not have any. We have gotten a few quotes and it would cost almost a grand a year for basic insurance. ( I personally believe it is well worth it!) Our board fees that $1000 a year is to expensive and unless it is a law they most likely will not get it.

I cant seem to find out much info about it actually being a law or not. ( Plenty of people willing to sell it though!)
Please advise...

I don't know if it is a law in your state ..but what are you insuring? $1000 is not much. Our HOA(we are 300 single family houses) has a pond , a gazebo, entrance monuments, and some landscaping. Our insurance is $3000 for liability. It also covers the Board in case we get sued by homeowners for 'bad decisions'etc. One law suit that your HOA loses (slip & fall etc.) could cost each homeowner way more than the price of insurance.

I would explain the liability for each Board member and each homeowner/member before decisions are made.

Liability insurance would cover you as a member of the board for any accident, etc. that may occur on the associations property.
Other coverage, commonly referred to as D&O insurance, that is, insurance for board members in the event for instance a board member should perform an illegal act in the name of the association, you would be protected in a law suit up to the amount of the D&O insurance.

I have sat on several boards of directors in my lifetime and was told by my attorney many years ago, if the board does not carry liability and D&O insurance, don't run for election to any board that does not carry both.

You really can't put a price on that kind of protection in light of the letigious society in which we live.

The quotes are just for general liablity insurance, not for the board members. ( in my real line of work I have tuns of E&O insurance, 3 times the state requirement. I am of the mind set better safe then sorry!)

We have a pond and grassy areas... Its a night mare what is going on. Our leadership has NO idea how to run water let alone a HOA! No one wants to listen to me. Its just a really messed up situtaion right now!

You don't mention how many memebers your HOA has. But, in the event that Texas law does not require insurance and the Board refuses to purchase it I suggest you either spread the word among your neighbors and get a majority vote, or recall the Board.

One child who wanders into the pond unsupervised and ends up in a coma for 10 years could bankrupt everyone. (again a matter of laws in your state as to homeowner liability, but it trickles down into assessments and fees regardless)

We are an new HOA in a new development of 25 homes. I am the first president and met with my board (sec & treas.) this week. We discussed liability insurance. I just read the emails about this and am wondering if anyone can give me the name of an insurance company (or several) that provide this type of insurance ?
We are in the state of Oregon.
Also, we have over 400 acres of common area, no ponds or swimming pools, just wide open spaces with small trails. There are no motorized vehicles allowed in the common areas, only horses, bicycles, or foot traffic. If you post this area and put up no trespassing signs, does that change your liability should someone trespass, hurt themselves and want to sue you ?

Dear Marsha: Yes you can be sued yes they can take away every dime in your development will ever raise inscudeing takeing over the streets of your community and too boot invokeing a toll charge to enter or leave your home it has been done in the past and might be done in the future. There are more lawyers in just the state of florida than the entire nations of, the UK,Japan,China both chinas. And all of europe.
Next question have you ever heard of a lawyer being in a unemployment line.

Dont risk what you have protect it.
Supposeing you have a wild fire, supposeing somebody hits your walls supposeing a cop falls out of his patrol car while answering a call in your hoa. They all have unions that have lawyers on call 24/7 protect your hoa or get the heck off the board and get somebody in who realizes you are a independent city entity start acting like one not some social club. Its your home you are gambling with. I personally have learned due to a sinkhole that cost us over 5 million dollars in lawsuits and litagation to rectify and we had the best lawyers in florida and the developer is the largest in the entire nation. Who won simple the lawyers and the developers so get used to it and work around it. You can win the small battles but unless you pay close attention to records you will loose the war Good luck

I have contacted Allstate - no.
I was told State Farm might.
The big one I guess, is Chubb. I have heard good and bad things about them - but hear they are about the only game in town for HOA insurance coverage. Is this true ?

I am in an 87 unit townhome development in Minnesota. We have had excellent results with State Farm - property and liability insurance for the Association. A lot of owners have also used them for individual policies.

Check out Nationwide. Our HOA carries both liability and BOD insurance. We shopped quotes last year and it's difficult to find a company that will insure corporations (which we are).

Our Brevard County,FL HOA just received notice that our insurer, Nationwide, is no longer doing business inf FL. Our agent expects out insurance to rise to $2500 from $425 if he can find a company to write the policy.

Any info about companies writing in this area greatly appreciatied

We've only received a quote for BOD liability coverage at $997.00!!! Agent trying to obtain Property Liability and Property coverages. Not a pretty picture.

Be gratefull I signed the check today for our Liability and property insurance $14,750.21 total for 1 year and you cry about $1000.00 Move to Florida and watch what happens

We are in Florida, but are an 8 Townhouse Homeowner Association without much common property, unlike Condo Associations. That is why our premiums have bee so low for so many years.

There is no reason for the drastic increase in Director and Officer Liability and Association Liability premiums - they have nothing to do with the Hurricane damages the Inurance companies are crying about.

We have not been able to get a Property quote and most likely will self insure on this.

What property management co do you use we have Landmark.
On the insurance co call lisa at954-924-3054. Our company is from Scottsale Arizona. Our BOD and employee insurance is about $300 per year. Tell her I told you to call my name is Jack Murphy Treas of Hampshire Homes of Miramar Inc we have 307 homes and we charge members $85 per month. We have 20+ acres corner of palm and miramar pkwy. We cut lawns front rear and sides of all homes plus common area 23 lakes 2 pools 10 streets total full length streets we own everything

But let me clue you in find yourself an Independent Adjuster and keep his/her number in your special book.The reason is all the companys use them and that gives you very special data to fight with these folks as they will short change you in a minute. Make sure you have in the policy walls,fences. We got beat up preety bad with the company cause we did not have fence-walls on our policy all our street signs blew away, as did all 44 stop signs and our bulletin board so it was preety bad. We also lost our very high fenceing around the basketball court.
Scottsdale uses the team approach on claims and most of the time they will win but once in a whle they let you win

I forget to answer you question about a management company. As we are only 8 units, it doen't pay for us to have a management company. We have been doing it all ourselves and our monthly fee is only $125/month which is pretty good for ocean front townhouses.

Hi Jack, I am a board member for a 154 resident community in Stuart Fl. Where are you located? Our insurance coverage for property and causalty will not be renewed for the POA. Do you have any referals from any research you may have done in the past? I wrote down the Scotsdale Ins. 800 # and will call them soon. Somewhere in my internet searching I found an article about lawsuits with Chubb...I think they may we risky. In the meantime I am finding one here and there.

Our previous coverage did not include the fencing around our perimeter and in the 2004 storms took it down - you are absolutly right about making sure walls and fencing is covered..they are assets!

HB, check your Declaration. Many state that insurance must be carried and list a minimum required amount. Even if not required your HOA should have insurance - we live in a litigious society.

Hi Margaret,

Another company to try is Clanendon America which is the company our Orlando HOA ended up with after Nationawide refused to renew in our area of Florida. Two other tips we learned after this renewal - make sure the coverage is complete (i.e., the earlier recommendation about street and stop signs if need be) and the replacement cost for covered items is not under-valued ont the policy.
