I HAVE LIVED IN MY HOME FOR 5 YEARS NOW. THERE IS A HUGE OAK TREE IN THE FRONT OF MY HOME AND 1 IN THE BACK. THESE ARE ON COMMON GROUND. THE HUGE BRANCHES ARE GROWING OVER MY ROOF. IS THE HOMEOWNER'S ASSOC. RESPONSIBLE TO KEEP THESE TRIMMED.
I LIVE IN FLORIDA AND LAST YEAR WE HAD 2 HURRICANES. I REALLY DON'T FEEL SAFE!

Are they on common area or on a public parkway? (Do you maintain the grass they are on or does the association?) If it does in fact belong to the association, contact them in writing and request that they trim the trees back due to safety concerns. Then, if they will not, at least you have a record of your request . If anything happens you will then be in a better position to possibly recoup damages due to negligence or lack of due diligence.

yes the trees are on common ground and yes they mow the lawns. thank you for your response.

I was advised thatif the trees are encroaching on your property you have the right to trim them in line with the property line in Florida. This is what I did, of course I had to absorb the costs.
