Our association is underfunded and California has no laws regarding funding except for the board's fiduciary responsibility. Every year there is work that is deferred. We have had drainage problems over our entire complex which the City of (**) says will cause problems. I'm told by the management company that I'm the only one who complains and therefore it probably won't be taken care of. Also, the water drains from North to South of our buildings and I'm on the South end and get flooding. The pipes were cut several years ago because they weren't properly maintained and water comes up to my front door and no place for the water to drain. I don't know what I can do about this and so far haven't gotten legal advice. Our CC&R's state that the property must be maintained in first class condition and good state of repair at all times. Any comments welcome.

LindaL, have you put your problems in writing along with quoting the CC&Rs that are being violated? If not send a letter to the Board and a copy to the MC requesting correction be made within the same timeframe that they allow for correction for Covenant violations. Also state that if the repairs are not completed within that time, and they have not been in contact with you, that further action will be taken (you do not have to specify what action of several options may be taken).

I submitted a request to have the property properly inspected which they refuse to do so. Their favorite retort is that I'm the only one who complains; therefore that gives them the right or excuse to continue deferring this. I just got a copy of the most recent board minutes and this is what they stated:

The board of directors responded that there have been no complaints of any common area drainage issues over the past several storms. It was noted that some front units have ponding issues at the base of the buildings (due to the fact the buildings are lower than street level), but this condition has existed since origination. Because there are no specific complaints pending, the board "tabled" any actions on drainage improvements at this time. There is an existing extimate to install drains at building 2630 (my building) for $3495. The board will monitor drainage issues over the next several months.

I live at the South end of the building and the pipes were cut with no place for the water to drain (previously it drained underground). Not all pipes on the rest of the buildings had to be cut which explains why I'm the only one complaining; so they say.
