Hello, I live in WA state. Our HOA consists of 49 homes and our neighboring associations CC (28 homes) and FG (15 homes) share a storm drain vault with a grassy open space above it. There has been much confusion about who is assigned the responsibility of mowing and repairing the sprinklers that are broken. The area has not been maintained for 3 years and it is all moss and weeds. To add to the confusion, the storm vault was not cleaned out by the developer and it will cost over 15k to clean out.

We just picked up some maps and covenant documents from the county for all 3 communities. It turns out that FG has responsibility for the landscaping, but the community is still under control of the builder. Their covenants state that our HOA and CC are to share maintenance of the vault. Sounds easy until you read our covenants. We are given easements for maintenance of the vault and access to the surface, with implications that we should maintain the landscaping. And then there's CC. They're a bunch of condos and they want to dictate who gets to use the open space and complain when kids play basketball on the pavement to the back of the open space.

It is my feeling that all three groups need to agree to turn the area into a useful shared park that is nicely maintained. All three groups need to pay a pro-rata share of the maintenance of both the vault and the park.

How do we go about negotiating this? Our management co wants to charge us $75 per hour to help us with this issue.
