I live in the Rocky Mountains of CO where fire danger is a real concern. This year, 2012, is especially bad due to lack of moisture during the winter. The homes are Patio Homes and the HOA is responsible for yard maintenance. Last fall the leaves where never removed. The actual response from the management company was that the leaves were mulched at the end of August. The leaves didn't fall until the end of October. After the devastating Hayman Fire of 2002, where this area was on 15 minute stand by evacuation notice, it was decided to put rocking around all of the homes for fire mitigation purposes. Since the leaves were never removed in the fall of 2011, the rock areas are no longer visible and the leaves are collected against my home. The HOA management company has done nothing to remove the fire hazard, although the weather has been dry enough to do so. And yes, I have contacted them. My neighbor even went to the TV media, where they broadcast the story on the local news. Still nothing has been done. I'm a senior and cannot, nor should I if I could, remove the dead leaves myself. The conditions this year are the same as they were the year of the Hayman Fire. What are my options for protecting my home and my life?

Contact your local Fire Marshal and request an inspection. If it is truly a fire hazard s/he will order them removed. Another option would be to tell the Board that if they are not removed, you will contact the Association's insurance carrier and notify them. Chances are the reason they have not been dealt with is that there is no money so be prepared for a special assessment to fund their removal.
