Our developer recorded our CC&R's in the neighboring county of Harris. Our developement is in Brazoria. The next for amending the CC&Rs states is should be filed in the public records of neighboring Galveston County.

I think the CC&Rs of our developement were poorly copied and did not end up being recorded in the County in which our development exists.

Is a CC&R filed outside the county of the development still binding? Seems it should be filed in the same county as the development?

It was actually notorized 1.5 years after it was dated. The developer has very sloppy records.

That's an excellent legal question. You should seek the advice of a local attorney.
