The CAM licensed Manager for our HOA (Seville Condominiums, Daytona Beach, Fl)leased out a condo in our complex even though it has been in foreclosure for 6 years. Three weeks after it pointed out to her that she HAD to know that was illegal, she forced the tenants to move but at our HOA expense. Now come on guys... This is total disregard for law and OUR HOA FUNDS. Who do I report this information to? EVERY work order ever done to the property under her management has cost the HOA MUCH needless money and she will NOT open the books after several requests to do so. The have been stop work orders, because she LACKED to check into the accreditation of the worker who installed new railings NO ONE WANTED! MORE TIME< MORE MONEY. The last "paint" job to our buildings, NO voted for the color...THE CAM Manager chose it on her OWN. It took SIX MONTHS for that painted to be completed and it STILL looks so unprofessional, it's embarrassing. This is after having the building "white washed a year and a half before, it WAS supposed to be painted WHITE! She verbally chastised an owner for caller her at 5 am when the hot water tank in the unit above the owner was flooding so much, her closet closings fell in!! Later that day, the owner called the CAM again and the CAM at THAT time responded she was working (managing another building) and she couldn't leave work, no matter the emergency! WHAT IS THIS WOMAN BEING PAID FOR??? How do we STOP CAM's like this from ruining the reputation of those who ACTUALLY DO THEIR JOB LEGALLY??? These are MERE SAMPLES of her malfeasance.IF any here is in a position of authority with regard to CAM licensing in Floria, please help me reveal this fraud for whom and what she REALLY is!

Your property manager works for your board. If they are not happy with manager's performance they are free to replace him/her.

Thanks all for answering. Yes Peter, you're absolutely right. I wish I could edit the topic..... another example of how you should think twice when writing in frustration. We've only 12 units, mostly absentee owners who have no clue about how their investment is NOT paying off.... outta sight, outta mind. There certainly will be a better thought out strategy before the next owners meeting! It just makes things difficult when 9 out of 12 owner's are so apathetic about what goes on...UGH!

You are again looking in wrong direction.

Do you have a board of directors? The problem can be solved overnight by your board. This has nothing to do with all owners meeting.

Unless, of course, your perception of problems is different from others and the board is happy with this person's performance.

I know this sounds crazy, but the truth often is. "Board Members" were APPOINTED by this woman, not voted on. Another illustration of the apathetic owners. I talked to the VP of our Board who learned he was the VP several weeks after the fact. He was "Given the title" by the HOA Mgr. There was no "ELECTION". There is a laundry list of things I could site, but anything beyond this point would simply be drama. I'm all about doing things the RIGHT way and in the BEST interest of the people you are PAID to represent. Currently, this is far from the case. I am speaking with owners as opportunity presents itself. It's an arduous journey, but one well worth undertaking to preserve the quality AND reputation of Seville Condominiums. Some MAJOR changes are needed to arrive at restoration. I know I have 3 owners who totally support my position, but only 1 is on the board. We simply want that small community charm to return that we enjoyed before this woman was hired 6 years ago. It's been a project awakening sleepy owners..... though progress IS being made, thankfully. The "VP" stated he will be at the February meeting and nominate a new Mgr, hopefully the "board will awake", following the VP's example after his case is made. So thanks....I am trying to work through the board to resolve this. All input has been appreciated.

Mark, call for special elections have a new board elected or talk to members of the current board and explain to them what is going on (assuming it's going on) and how they can be personal liable for their actions.

Who is paying this person's salary? You can stop it tomorrow.

You need to ask specific questions if you need help with how to deal with the them. For now it sounds like you are a frustrated homeowner but you are not doing what's required to change the overall picture.

Thanks Jeff, I Am attempting to network within the board. In itself a difficult feat. I, after much research, now now the direct way to go that is also within our HOA REGS., which I've completely read again. I appreciate your understanding of my frustration, however I now have a plotted course which in great hopes will finally resolve the current management issues.

While not accusing you of being wrong, I ask a tough love question. Are you one that moved into a CC&R, Covenant controlled development and never paid attion to such until things did not go your way?

Are you still under control of the developer or has control been turned over to the membership?

Typically when the developer is in control of the Association, people are appointed vs. elected to the board.

Not familiar with FL law and CAM's, but I understand that they must obtain a license from a state agency. Which agency? Is there a way for you to file a complaint with that agency?

BTW, who hired her in the first place?

CAM managers are Licensed and complaints can be filed through DBPR, Department of Business and Professional Regulation. The website is myfloridalicense.com however, remember, that she is an employee of the Association and serves under the Board of Directors. If there are no active Board members and no directions given to her, she could very well be running the Association on her own. It sounds like the Association does not have active Board members,that is the biggest mistake.

Perhaps taking a long hard look at the HOA laws of Florida (720) you will discover that Both your manager and your board are in clear violation of the law.

I strongly suggest that you communicate with all 12 owners in writing (certified, return receipt requested).
Follow the 720 law. Here is a link to paste into your browser:

Ask them to sign your petition to:
1.Recall the current Board.
2.Hold a homeowners meeting to elect a new board.

If they cannot attend a homeowners meeting ask them to mail their proxy to you authorizing you to vote for them at the meeting.

Then, when you become President with a board that actually cares about doing the legal and right things, you can fire the manager and hire either a new CAMS manager or employ a property management company who will do what the board wants done.

TIME FOR REAL CHANGE AFTER 9 YEARS OF BRITISH NAZI RULE~!!

No time, this complex has been condos since the early 70's. Developers are LONG out of the picture. Our non-interested and inactive board seem to be deferring all decisions to this person.... who is literally, running the complex in the ground. I , along with one other owner, seem t be the only two who care about anything and all the4 mess ups this woman has cause.

Allow me to clarify, I am a LONG Term Lessee, I've been here 9 years, and made Several imnporvments to the property out of my OWN pocket as no else seems to care. I HAVE however, received a motorized proxy from the owners of my unit to vote on ALL homeowner (HOA) matters on their behalf. The MAIN objective is to loose the dead weight, incompetent leach of a MGR we are NOW contending with..... as I campaign to be nominated and elected the position Property Mgr, I hold 5 of 12 owners so far who I have personally spoken with, all of whom are RIGHT BEHIND me.... so it's a difficult uphill battle as I am NOT actually an owner....YET;Though I could not seek the Mgr position if I were currently an owner. SOMEONE HAS TO TAKE RESPONSIBILITY to get the Seville Condominiums BACK ON Track to the small community charm we enjoyed before this woman we hired..... With The Nazi communication style and incessant demanding,egotistical Character of the current mgr who ACTUALLY BELIEVES (as demonstrated by her behaviors) SHE OWNS THE BUILDING and behaves as such. NO ONE but me and one other owner will stand up to her...the absentee owners have NO clue what drama and excess spending which happens here, they only know what the MGR emails them. This woman could NOT manage 2 dogs walking across a street, let alone this complex!

TIME TO TAKE Action...and I WILL report her for the illegal leasing of a foreclosure unit this past summer! I understand the regs regrading that changed Jan 1st 2012, but this wa BEFORE the revision of the HOA Laws... again a mere example of the years of malfeasance of this know it all woman with a Bonaparte complex!
