Management Company personnel (managers) are agents of the Association. Therefore, they most likely have a right to attend the meeting. They do not have a right to vote at that meeting unless they are a proxy representative for some member.

The contract between the HOA and the MC would list the duties of the MC. If attending the annual meeting and giving a report to the Members is listed,then yes, they must attend.

I would think that the Members would want a rep. there from the MC to answer questions.

that's only because your board has allowed it. a management company always works for the board and will do whatever is authorized to do by the board.

the mgt company can't take over the board, the board is the ultimate authority. If the mgt company is overstepping their bounds then your board needs to do something about it.

If they are agents (and they are) their duties are determined by the board. It may make sense for the manager to be at the meeting, but he is there at the pleasure of the board, and must leave if that is directed.

I had been on the Bord in the past. I'm older and got burned out and did not run again. We have 376 condos. We have a new Board from thre last year and unknoledgable and the management copomay is directing the Boadr wrong.

Yes it is the Bords postion to run the Hoa but how, what can you do when the Bord is told that they run the community not the mangemnet co and they comtinue to take dirction from the mangement co!

One reason to hire a management company is to pass the unpleasant things on to them so I think many management companies might get blamed for simply doing things the BOD wants done.

As a neighbor, I would not want to do the unpleasant things like be fining my neighbor. Let the manageamnet company do it so I can commiserate with my neighbors...even when they are wrong......LOL
