On the board of director of a HOA in Florida. We want to replace our CAM. The question I have is we have a property management company running the HOA. They have a CAM. Can we use their CAM and hire an office manager for our office? Can't find anything in the Florida Statutes.

If you have a management company, I expect that the property manager works for the management company. Therefore, firing the management company and then hiring the property manager back as an independent contractor pay pose some issues for the property manager, the management company and the Association.

If the Board just want a different property manger, contact the management company directly - specify the reasons behind your decision and ask that they assign you a new property manager.

If the Board wants to fire the management company then hire independent contractors (CAM & Office manager) to do the work for the Board - you need to read the contract signed with the management company. You may have to wait until the contract is fulfilled.

Charles, the Board of Directors runs the HOA; not the management company. First I would negotiate with the management company to amend the management agreement to meet the terms the Board desires. The Board should define in the management agreement those duties they want to have the management company provide. The Board can request the CAM employed by the management company whom they want to use. The management company can agree with those demands or you can find a new management company. Or the Board can hire a CAM not employed by a management company who is an independent contractor for the functions desired.
