Our HOA has antiquated bylaws. They were written to allow the original builder to develop the HOA as he added homes. The community is now finished and we need to re-write / revise them to our current situation. In essence, we need a basic set of bylaws. We have 35 homes. Any suggestions as to where I might find a good template or current set of bylaws and CCR's that we could adopt? I have hunted on the web and have not found anything yet that fits our needs.

Aren't you a subdivision? If so, I'd sugest finding a similar HOA and requesting copies of their documents. There are also some lawyers who speciailize in HOAs.

Michigan does have condo laws but there's not much out there for homeowner's subdivisons.

Yes a small 'SD'. I hadn't really thought about reaching out to other 'SD's' but I like the idea.

I can give you a lead on CC&R's and Incorporation documentation. Not sure on the by-laws. You can find them at your local Staples/Office Max/Office supply type stores. They range to about $20 or less depending on if you get a CD or not. They are found in the "do it yourself" type document area like "Rental agreements" etc...Not a big selection may be available and you may just need to go to their site to order it.

It's a small package with paperwork necessary to complete the task. Some have their own CD and they adjust to each states laws. There's a variety of documents available. I've used some for rental agreements with my rental property. Pretty useful but still may need some modifications.

We had a lawyer help us with ours. Basically we redlined the copy we had. There's many small changes that will need to be made. Like removing ALL references to the builder or voting hierarchy. It's best to have a professional and a committee dedicated to modifying this. You can get a copy of your latest CC&R's from your county courthouse and the Incorporation from the State. By-laws aren't necessarily required to be filed. However, they may be filed with your CC&R's at the county level. They are more for the inside/exclusive use of the HOA while the other documents are more legally binding.

Good luck. It took us over 2 years and about 2.5K in cash to do...Just to give you a heads up...Well worth it!
