Our by-laws state that all persons who join the board must reside within our community.
There is a man who rents his townhouse out but would like to sit on the board (he would be
really good!) They are saying no because he does not actually live in his unit. Is there
something in the Pennsylvania Uniform Planned Community Act that would help our cause?

Sorry to say Cheryl, but no. The PA Uniform Planned Communities Act is silent as to the association's by-laws to establish residency requirements for members of the Board of Directors.

In fact, our docs do not even require association membership to serve on the board.

Thank you! Most of the board members (who are dirty) wouldn't want
this man on the board because he would not let them do the things they
are getting away with!

I fully understand. We had a similar situation until we got enough strong members on the board. Keep at it, I can attest to the huge impact having the right members on the board can have.

He who pays the HOA dues is property owner. The property owner represents the property and not a renter. This property owner is being disenfranchised.

I must concede I'm not a fan of landlords being on the HOA board.......but how can it be improper?

Fortunatey our documents allow any owner no matter where they live to serve as a Board member. We have a man on the Board who does not even live in our city. His wife lives here part time. They bought the unit so that she would not have to drive so far to get to work.

Could you documents be amended. There has to be a way to amend he documents. Granted this is not an eacy process, but it is feasible.

Our by-laws need rewritten! But the way they are worded it lets these scumbags
do as they please! It has been terrible the past year. The sad thing is there
are 520 homes and about 12 of us have tried to get involved. You get to the point
where you don't want to fight anymore, I feel like I have gotten to that point.
There are vacancies on the board but they will vote against anyone who isn't their friends.
