I have a property where the member passed away. Someone else bought the property back in 2010. No one has payed the Dues since January 2011. I went to put a lien on the property but the property is still deeded in the clerk and recorders office as the deceased persons. Can I place a lien using the deceased name or the current people who live on the property?

are you sure someone else bought the property? Ask the county clerk what is going on, you can only lien the legal owner which right now as you explain is the deceased person's estate.

That is the weird thing. I talked to the assessors office, clerk and recorder, and the treasures office and all three places still have the deceased persons name. Property taxes have been paid as well up to date.

Jessica...this is what I woudl do if your state allows. If all 3 places can't figure it out, Lien the property using the deceased person's name, after all they are still the legal owner. Perhaps the property hasn't been legally sold yet.
