My community has a rule against fences. Only perimeter fences around pools and fences along the side of the main road are permitted. I have planned to petition this rule, but am getting a lot of gruff from older members of the community. Statements like "If you wanted a fence, why did you move here?" and "Fences interrupt the open flow plan of the neighborhood." My stance is, peoples' lives change. I have no issue with writing a petition and collecting signatures. I'm writing this thread to fine people who have had experiences with this issue. Any information to help me would be most appreciated.

It's in the by-laws. I believe its been there since 'the beginning of time.'

go forth and practice democracy.

Talk to your neighbors, gather support, make proposals, follow the process, and see if you can effect change. If you can, great, if you can't, oh well. either way, the will of an informed electorate will be done.

If it's in the bylaws, you need to follow the procedures to change the bylaws.

Typically this would be:

Identify what you want the change to be (do you want any style of fence or specific styles? everyone can have a fence or only some? How tall may the fence be? etc. etc.)

Petition the board to hold a special meeting for the purpose of amending, Article ... Section .... of the Bylaws to read (what ever the change is)

Give the Board time to verify signatures and call meeting
Notice of meeting (w/proxy forms if allowed)
Meeting is held
Quorum requirement met
Discussion
Vote
Results
If successful - Publish new amendment to membership and file new bylaws with County (if required)

Thank you for your information. This is the exact process I was expecting to go through. There is quite a bit of support from my neighbors, I'll keep the thread updated with my processes. Thanks again.
