Since taking over our HOA in september our board has not acomplished anything. I am the vice president and was asked to aquire quotes for common area lawn care and maintenance.find a community sign. I did get the web site paid for" It was like extracting a wisdom tooth" Ha, Ha. and I found new recycled park benches. The president put aside all my work and announced her husband and family will take care of the grounds, she also took it upon herself to fire the landscape service that was in place. I feel she thinks this is HER Hoa and she is only in it to make her family money. Is this legal? Plus we are all temporary until our first meeting january 10th. I feel like I was given "busy" work while she is trying to make a play for herself. Thanks for any input on this. Everyone has always been very helpfull at this forum Thank you all bobg

HOA directors and officers should not financially benefit from serving on their community's HOA board. Sure, some by-laws in some HOAs allow for compensation but I disagree with it. It's how a president and her family come to be groundskeepers over professionals you can hold accountable and get higher service in all likelihood.

It's a board decision on who gets the contract not one persons decision.

It will most likely be up to you to bring this fact up and call for a vote. Additionally, because the President obviously has a conflict of interest, they should not cast a vote on who is awarded the contract.

Expecting that your Association is registered as a nonprofit, there are some FL corporate laws that apply which should help you:

617.0830 General standards for directors.

617.0832 Director conflicts of interest.

Judging by your comments it looks to me that a variety of 720 laws are being violated.
The Napoleonic actions of a HOA president must be confronted in public at all meetings and with the law.
Read your HOA Docs. They are not permitted to violate the 720 law.

Hello everyone bobg here again. First thank you all who reply to me for taking the time to do so. I have a question in regard to our 1st annual meeting coming up. I have decided to run for president, [ I am the interum vice right now ]. I have been told that onlt the board members vote for positions while the resident's only vote for board member,s is this true? because if it is the interum president has worked with the builder to "get" 15 sealed proxy ballots from him when he only holds 3 lot's! Does this sound a little fishy???

I am not sure about Florida law, but here in Texas the members can only vote you onto the Board of Directors and not into a specific seat. Once you are elected to the Board, then the new board members have to appoint each other to their seats accordingly. We have had a member like you are talking about that was attempting to run things herself and she ended up being removed from her position. It only takes a majority of the board to remove anybody from office. This should be fairly easy to do.

You are doing alot of work that your property manager should be doing, quotes, signs, website. Getting a good manager in place will solve your issues on the hoa and will give you more time to make decisions rather than doing all the work your manager should be doing. A good manager will tell you not to hire the presidents husband. An attorney will help solve the problem but you really need to get a good property manager. I am in Tampa and know a few.

Hello again everyone BobG here, First Thank You everyone for your response and assistance it is greatly appreciated. We held our first annual meeting and it went ugly fast. Very unprofessional and childish unfortunately. Our one board member who will be my parlimentarian was not permitted to speak at all by the president her drunk husband became beligerant, the entire room went against the gentleman who wished to speak so it became extremely unruly. when the dust settled and everyone calmed down we finished the meeting and had our vote amongst the board for president, vice and secretary and thanks to the help and guidence from everyone on this forum I prevailed as level haeded and fair and was unamously voted president ant the old one in gone. Noe I can do my job of serving at the pleasure of the people of my community. Thank You all again.
