This one may be a bit shady. I'm currently on the board as a VP and we have been completing a drain project
behind a retaining wall that later included unplanned repairs to the wall itself. This wall is at a property
boarder and extends from my neighbor's property line and my property line. We are the only 2 property owners in our
HOA that have this wall behind our homes. The President asked me to look at some posts supporting the wall and
we both agreed to add concrete as we thought if there was any, it was way below grade and the wood was already
rotting. On a different day the President decide to replace the boards on the wall. I was not asked and later I
was informed the Treas. agreed. There was then a vote after the fact via email with the rest of the HOA to get
permission for the expense of the new boards. Members were informed the work was already completed but were asked
to vote anyway. The posts that were re-enforced and the boards that were replaced were only on my neighbors side.
There was a majority vote to OK the expense.
On my side the wall is a bit taller and starting to lean. I inquired about repairs in 2010 and was told it would
be put off for a year or two as it has not completely failed. A couple days ago I received an email regarding the
next quarterly meeting and this statement was included from the President responding to the treasurer's mention of the
remainder of the wall:

" Their wall yes, but we should also discuss HOA responsibility as it’s not on our property. (Stay cool K, it has to be brought up and discussed)."

It would then be subjected to another vote. This revelation was not previously disclosed to the HOA
or myself during previous discussions or votes. I responded that if it was a legitimate concern then
it should have been discussed long ago and it may have influenced previous votes and may influence the
next vote. I also explained I suspected the President was acting in bad faith. We have had heated debates
before and I'm not sure this isn't retribution. Where do I go from here. The President has not responded
to my accusation. Thanks in advance.

Backtrack into the minutes and find the exact wording of the motion to repair the wall. It should be clarified there.

I don't know why you say "the president decided" . . . he is one person on the board and decisions need to be passed by motion.

BTW - who exactly owns this wall? First you say it's common area, then you quote someone on the board as saying "it's not our (HOA responsibility) property.'
