I am a Board Member in Ca. Our condo complex is currently subject to Declarant Control because the majority of the units did not sell. This means that the 2 owners who are Declarants always have the majority vote. There are 2 of us resident homeowners who are on the Board. Both of us feel strongly that we need a new Association Manager. In August of this year, we had a Special Meeting and discussed the subject. The Declarants shot down our request stating that it was not in their best interests to switch Management Companies while they are still trying to sell their units, so we are saddled with our current Association Manager. Ever since that meeting, the Property Management Company has become very unreliable about returning my emails. Previously, they would respond within a day or so to my emails. Now, I will send emails with questions or concerns, not hear anything back for days, then email them again to find out if they ever received my email and not hear back for a few more days. Recently, I sent a list of 5 time-sensitive questions, nine days passed with no answers from them. I finally got an answer from them today because I asked them in person at a Budget Meeting. When I have asked them why there is such a delay in providing answers to my questions they give me generic replies such as - we have received your emails and are working on them. When the declarants send questions to the manager they are responded to within hours.

Are there any laws on this subject? Can they continue to ignore a Board Member and get away with it?

Yes.

The management company seems to know which side of the bread is buttered. All you can do is wait it out.

Keep cool,document everything you do.Be creative about different approaches.Don"t quit,be diligent.
I am a HOA president for the past 19 years,I have had many board members who have had there own agendas.They go away over time.Look for more support. Good Luck

not sure of your relationship with the declarant but I would request a meeting with this concern being raised. If they want the management company then they should abide by good business practice. Chances are you don't have a lot of leverage so your approach will be key to getting any resolution.
