I am a HOA President. I need to call a executive session.We are in the middle of a election,and our secretary is being accused of election tampering by members.They have given me a list of events regarding her fiduciary duties,being in question.These guys are mad.What rules do I need to follow as far as posting and putting a topic of the meeting on our bulliten board. Since she is the one in question,can she be there?

If I were faced with the same circumstances, I would call the meeting and include everyone, including the accused, to get the issue out in the open.

As of today, no notice to the members is required. On Jan 1, 2012, the rules will change. Please see below link.

Here is Davis-Stirling.com's webpage on executive session.

Basically, you go into executive session from an open meeting. Therefore, you would initially hold a normal meeting then move into executive session, return from executive session, vote in open session then adjourn the meeting.

The minutes might read:

President opened meeting at hh:mm
Approval of past minutes
Motion to go into executive session for the purpose of discussion issue about abc
Vote to go into executive session
Board went into executive session at hh:mm
Board returned from executive session at hh:mm
Motion to [whatever action ] concerning abc issue
Vote on motion
President adjourned the meeting at hh:mm
