I was told that this should be a new topic and so am restating it here.

One of our Board Members (the Vice President) is in violation of the Covenants and By-laws in that he is building an oversized shed (that was also being built without the necessary permits from the town and has been addressed to them for action) but the work has gone on far longer (about 14 months) than the 90 days allowed. We live next door and all we can get from him and other members is that he injured himself while working on the shed and is now incapable of continuing. The Building Committee Chairman granted him an indefinite extension and no other Board Member will take action against him. We want to sue but cannot afford it. This is impacting our ability to sell our house, which we need to do since losing our jobs a couple years ago.

Any advice here on getting the shed removed (it is way too large, which is acknowledged by all involved) and getting the mess cleaned up so we can list our house? We need this done by next Spring.

How is this effecting the sale of your home exactly? Just because it's an eyesore, it is an eyesore next door...You don't know if you can't sale if you don't try. I can't tell you why one person decides not to buy a house versus another. I've not wanted to buy a house because it didn't have a dishwasher...It's just an assumption on your part that this shed would be the issue someone won't buy your house.

The city can revoke this person's building permit if they choose to. It just sounds like the HOA board has extended their approval. The City is probably taking their cue from the HOA on how the situation is being handled. If your moving, why worry about it? It's the HOA's problem after you sell and move.

Let your Realtor do the talking when selling your home...They can sidestep a few issues for you so the house can sell. It would just be nice to offer up the new owner a copy of your CC&R's at the closing....

You have three options:

1. complain to your board or PM and ask them to take action...
2. Complain to the city and ask them to help
3. Sue via the court system

No easy answer, i am assuming you have gotten feedback from potential buyers about the shed due to your comments about it affecting the sale.
