If an HOA has a rule for only one garage sale per year, how can it really be enforced? What would keep someone from having a sale whenever they wanted? After all, the CCR's say a person must be given three warnings before being fined; by then the sale is way in the past.

you write the warning to cover the sale observed, and any future sale that may occur. The HO doesn't get warned three times for every sale, and a new sale does not mean he gets three more strikes.

It isn't the HOA that has rules on Garage/Yard sales. The city and county has them too. We don't have garage/yard sales on sundays - thursday in my area. There are a limited amount we can have them too. A person having continous sales can be reported to the city business or code department for operating a business without a license. There was a person who had one every weekend before they made them get a business license or quit having them.

You may want to check your local laws/ordinances on how they handle excessive garage/yard sales.
