Summary:

I'm in Calif.

Ballots not done via Davis Sterling, board knows it. I talked to them, sent them letter etc.

They moved counting of the (illegal ballots up to day with proper notice).

Question:

Per Davis Sterling 1363.03 the inspector shall 'hear and determine all challenges and question in any way arising out of or in connection with the right to vote'

I just now read that.

#1. Soooo shall I raise my hand and make a simple statement that my right to vote was denied because a secret ballot was not provided to me then sit down?

2. Does this statement need to be included in the minutes of the meeting? If so, how do I make sure that it is?

Oh gosh, I forgot to mention the vote is at 10am PST, that's why I wrote HURRY! I need some help asap!

It's typically best making any challenges to a vote before, during or immediately after the voting. At the very least this says you didn't wait x months before complaining.

I would also change the question. You should ask "why are these ballots not secret as required by Davis-Stirling?" then have copies of that section of the act.

I say that this question is better because, if I recall correctly, you were offered an opportunity to vote, you chose not too because the vote was not secret. Asking the wrong question when challenging something can result in you losing that challenge.

I spoke with a board member about it on Nov 3rd. He told me the law did not apply.

I wrote the entire board on Nov 5th.

Prior to today, nothing had been done yet, so there was time for the board to reissue ballots etc.

But the did not. They make a choice to ignore the law.

And I have 15 minutes to decide! Yikes!

I think I need to make a simple statement that my personal right to vote was denied because I was not provided with a secret ballot, per California State Law. I have the Civil Code print out with me.

They may not even allow me to speak, which would be another violation.

We will see...

PS: It was not a matter of 'choosing' not to vote, I was denied the right to vote. The ballot contained my address, which is in violation of state law. It is in breach of my confidentiality.

Cookie, while you are right about the law and that the vote is not being done correctly, I still think you chose not to vote. You might have been denied a right to vote with a secret vote, but not to vote at all.
