Our bylaws state that the Architecture Review Committee (ARC) adopt guidelines and submit them to the BOD for acceptance. Do they have the power to enforce guidlines that the developer put in the CC&R's before they have completed their process?

The CCRs are more powerful (take precendent over) than any rules and regulations that the ARC would adopt.

No choice in whether or not to enforce the CCRs - unless they get amended, which is usually an arduous process.
