Hi,

A member of our association has asked for a hearing. Only 1 of the 3 members of the committee
ssem to be available in the next few weeks.

Can a new committee be put in place after a hearing is requested?

I thought I read somewhere that the committee must be in place prior to the hearing but I am not able to find it right now.

If two new appeals committee members were chosen now one could say they were chosen because it was known how they would vote.

If anyone has any info on this it would be greatly appreciated.

I would explain to the individual that the committee members are not available until mm/dd/yyyy and if this would be good for them.

I would not replace the committee members for the sole purpose of being able to hold an appeal hearing quicker.

There may be a time frame to follow IF the petitioner requests a hearing e.g. 30 days from receiving the request for hearing, the hearing must be held.
Your appeals process will explain that.

If the committee cannot meet its obligations, it needs to inform the board. Ignoring or putting off a hearing request MAY make it null and void and give permission to the petitioner, by default.
