We have a board that allows a manager to allow personal issue to get involved in her duties.
We want to remove the board and get a new one
our bylaws do not allow this action
What can we do to fix the situation

Read, your state condominium act or corporate code for non profits. I am sure there will be provisions on how to remove a board. If so that section of your bylaws would be void because your governing docs may not conflict with federal, state, local laws.

Before you go that route, which will be long, maybe you should consider talking to your board and find out what's going on. Remember your manager / management company works for the board, so if they are ok with it they are not violation any rules and you may be fighting an uphill battle.

My understanding is the board condones this kind of action

I understand the task at hand but several other residents have asked me to find the method of removing the board since they are of the understanding that she can impose at will her power.

If you want to remove the board the process should be well documented in your Bylaws. But do you really want to remove the board? Think about it. Tomorrow a new board might hire a plumber that you will not like - remove the board again?

I don't know exactly the behavior you are refering too, but property management is not an easy job. Sometimes the only way to do it is to be strong-willed, and even somewhat rude. That way people don't try to play on your 'nice' side to get away with things.

Is it something the Board could correct? Have you tried to address this with the current Board?

To jump to the conclusion you need to remove the Board seems a littel drastic to me. How many Board members serve? Yo intend to remove them all?

And if successful are there people in line to assume their positions? And if it becomes necessary to remove the MC you have a replacement for them as well?

And besides this issue just what sort of job is the Board doing?

As others have suggested removing the Board or sttempting to do so can be quite a long and difficult process since in most cases they don't simply pack up and leave when you decide they should go. Before I embarked on that rip I would make sure you have the time, effrot and most importantly the asupport of the necessary owners to have any chance of doing so.

Why not use the election process to remove those you are unhappy with?

And just curious what exactly do you mean when the MC allows personal issues to affect their job. Can you offer specifics???
