Just and FYI to all my fellow Hoosiers..the Indiana State Legislative Session begins today 1/8/07. Senator Brent Waltz has authored a modest HOA reform bill now known as SB 0027 (HOA ELECTION DISPUTE REFORM) which will be introduced this session. While the "life span" of most bills can be quite short, it is very encouraging to have had so quick a response from one lawmaker and to have an oppotunity to be heard.

Much work needs to be done with this bill and this will most likely be a campaign for reform that will last several sessions. Please, contact your state senators and make your voice heard. Reform in Indiana is what is needed HOAs going forward and will help to preserve more than just property values... it will preserve neighborhoods.

The House now has bill # 1325 introduced which is a comprehensive bill designed to protect the rights of homeowners in a HOA in Indiana. The authors of this bill are Reps Grubb, Hinkle and Moses.

Please, please, please contact your State Rep and ask them to read and support this bill.

Have you heard anything further in proposed legislation in the Indiana General Assembly? I know that HB1325 was reintroduced as HB1080 last year, but was not acted upon.

Do you know if there are plans for reintroducing the bill in the upcoming legislative session?

Thanks for posting this link - I will bring this to our board meeting next month and see if I can get our state representatives to stop by to discuss their thoughts on this issue.

From reading the article, I can only shake my head - our board has trouble getting ANYONE to respond to ANYTHING and other HOAs are behaving as if it's WWIII. This should serve as a good wake up call to some of my colleagues who get frustrated at the apathy and think they can go ahead and do whatever. I always say no, no no (like Amy Winehouse - minus the drugs) because it's lawsuits like this that we need to avoid at all costs. We're supposed to be adults and able to handle our affairs decent and in order.
