Colorado Senate Bill 05-100 (now law) contains a, so called, "blanket" requirement for use of a secret ballot for all board member elections. I believe the rationale is to make a secret write-in possible even when there is only one candidate.

I understand a "clean-up" bill that is supposed to fix-up minor discrepancies may remove the blanket requirement and allow board discretion or require a percentage of members to request a secret ballot.

If this passes, I think it is a big step backward for homeowners' rights and a potential victory for oppressive and abusive boards.

Does anyone agree?

LuciusD, a secret ballot requirement was already in the bylaws of several HOAs we manage. Perhaps some people are intimidated or don't want others to know how they vote.

IMHO, the secret ballot is rediculous when arms need to be twisted to get enough volunteers to fill the open board positions, e.g., 2 openings and only 2 candidates.

Personally, I think this item does not merit more consideration.

Roger, I'm not especially surprised by your reaction.

However,if a secret ballot requirement is in some of the bylaws of the association you manage, then I applaud their authors. I think it is the right thing to do. But I do not think this is the general case. We are not all that fortunate.

I think the authors of SB-100 had good a good and sufficient reason for including this requirement. I do not think it should be removed. Or at least not until we have tried it for a couple of years to see how it works.
