I was unable to get past information on this.
My question is : If the Association provides a cable to each unit (condo, must they also allow a dish?
Thanks, Deb R

I don't know where you're from but here in Florida the legislature passed a law that Homeowners' Associations cannot prohibit Satelite Dishes. The only thing we can do, is tell homeowners where to put them.

DebbieR, check out the FCC Over-the-Air-Reception Device Rule (OTARD Rule) which was adopted in 1996. In short, the OTARD Rule prohibits restrictions that impair the installation, maintenance or use of satellite dishes that are less than one meter in diameter, TV antennas of any size, wireless cable antennas and customer-end antennas that receive and transmit fixed wireless signals; referred to herein collectively as an antenna. Installation, maintenance or use is impaired if a restriction 1) unreasonably delays or prevents installation, maintenance or use; or 2) unreasonably increases the cost of installation, maintenance or use; or 3) precludes reception of an acceptable quality signal.

This Rule is fairly clear for those who own the outside walls and roof, such as single family homes, but is not clearly defined for condominiums where only the air space is owned.

For condominiums, the rule is a little more ambiguous, as Roger indicates. The owner is not protected by the Telecommunications Act of 1996 if in order to receive a signal, the dish, at any point, has to extend into the common airspace. The Association can indeed prevent an owner from installing a dish in that manner. Re; you can't install it on a condo roof but you also can not install it on a balcony or patio where any part of the dish extends beyond the face of the outer building wall. The installation of the dish may be permitted, however, by other governing documents at the state and local levels. The Telecommunications Act of 1996 is a Federal ruling.
